David Protein is facing a proposed class action that challenges the nutritional accuracy of one of the most talked about protein bars in the health and fitness market. The suit, filed on January 23 in the U.S. District Court for the Southern District of New York , accuses Linus Technologies Inc.
, the food technology company behind David , of mislabeling the calorie and fat content of its bars. The brand built its entire identity around an extraordinary nutritional claim: 28 grams of protein , 150 calories , and
0 grams of sugar per bar, marketed as one of the highest protein to calorie ratios available. That promise is now at the center of a legal dispute.
What the Plaintiffs Are Claiming Lead plaintiff Daniella Lopez , joined by David Freifeld and Crystal Paterson , alleges that independent lab testing using the Atwater factors method, a widely accepted method for calculating food energy, found the bars contain between 268 and 275 calories , up to 83% more than the labeled 150 calories.
Fat content tells an even starker story. The lab results reportedly found fat ranging from 11.8 to 13.5 grams per bar, compared to the 2 grams stated on the label, representing up to 400% more fat than advertised.
